Terms of Service

These Terms are an agreement between you and Teddy Dupay Basketball Academy ("TDBA", "we", "us"), a Florida business located at the Activities Building, 2nd Level, 302 W. Kennedy Blvd, Tampa, FL 33606. They cover your use of teddydupay.com (the "Site") and the classes, camps, leagues, private lessons and memberships we sell through it (the "Programs").

By using the Site or signing a player up for a Program, you agree to these Terms. If you do not agree with them, please do not use the Site.

1. Who may sign up

Programs are for children and young people. Sign-ups are made by a parent or legal guardian, not by the player. By registering a player you confirm that you are that player's parent or legal guardian, that you are at least 18, and that you have the authority to agree to these Terms and to our participation waiver on their behalf.

2. What we ask you for, and why

To put a player on a roster we ask you for the player's name and their birthday or age, and for your name, email address and mobile number. We ask for the birthday or age because our Programs are grouped by age and skill, and putting a child in the wrong group is both unfair to them and unsafe. Some Programs also ask for shirt size or jersey number.

3. Payment

Payment is taken by Stripe. Card details are entered on Stripe's own checkout and TDBA never sees or stores your card number. Prices shown on the Site are in US dollars and include no additional booking fee.

Memberships are monthly subscriptions. The day you sign up starts your billing cycle — we do not prorate and we do not reset to the 1st of the month. Full membership billing and cancellation terms are in our Cancellation Policy, which forms part of these Terms.

4. Cancellations, refunds and changes

Memberships — cancel any time before your next billing date. There is no minimum term. Once a cycle has been billed, that cycle is not refunded. See the Cancellation Policy for the ways to cancel.
Camps, leagues, classes and lessons — these are one-off purchases. If you need to move a booking or you cannot attend, contact us and we will do what we reasonably can, including moving a player to another date where a place exists.
If we cancel or reschedule a session, camp day or game for any reason, we will offer you a credit toward another Program or a refund for the part not delivered. Your choice.
Weather, facility closures and circumstances outside our control may force a change of date, time or venue. We will tell you as early as we can.

Nothing in this section takes away any right you have under Florida or federal consumer law.

5. The gym, and behaviour in it

Players must be signed in at the gym. Please arrive a few minutes early.
TDBA coaches and referees run every session. We may ask a player to sit out, or ask a player or an adult to leave, where behaviour is unsafe, abusive or repeatedly disruptive. Where we do that mid-Program we will act reasonably about any unused portion.
We do not provide supervision outside a session's stated times. Please collect your player promptly.
TDBA is not responsible for personal property brought to the gym.

6. Participation waiver, and risk

Basketball carries a genuine risk of injury. Before a player takes part you will be asked to sign our participation waiver, which is sent electronically. The waiver is a separate agreement. Where anything in these Terms and the signed waiver differ on the subject of participation risk, the signed waiver governs.

7. Photographs and video

TDBA films and photographs at the gym for coaching and for promoting the academy.

If you do not want your player photographed or filmed for promotional use, tell us — by email or in writing — and we will honour it. You do not need to give a reason.
We do not publish children's names alongside images on our website. Where a testimonial or a review is published, it appears under an adult's first name or anonymously.
Coaching film shared privately with a family is not published.

8. Messages from us

When you sign up we send you the emails that go with your purchase — your confirmation, the details for the night, and a follow-up afterwards. You can stop non-essential emails at any time using the unsubscribe link in any of them, and that will not stop you receiving a receipt or an essential message about a Program you have paid for.

Where you have given a mobile number we may text you about the Program you signed up for. Full SMS terms — including how to stop messages — are in the SMS Terms & Conditions section at the end of this page.

9. The Site itself

We work to keep the Site accurate and available, but we do not promise it will be uninterrupted or error-free. Program dates, times, prices and availability can change, and the Site may occasionally show something out of date. Where the Site and a written confirmation from us disagree, the confirmation is what you bought.

You agree not to misuse the Site — no attempting to break into it, scrape it at a scale that degrades it, or use it to send anything unlawful.

10. Our content

The text, photographs, video, coaching material and logos on the Site belong to TDBA or are used with permission. You may share links and normal quotations. Please do not republish our material commercially without asking.

11. Limitation of liability

To the fullest extent Florida law allows, TDBA is not liable for indirect, incidental or consequential losses arising from your use of the Site. Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Where liability is limited and permitted to be capped, it is capped at the amount you paid us for the Program in question.

12. Governing law and where disputes are heard

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You and TDBA agree that any dispute will be brought in the state or federal courts located in Hillsborough County, Florida, and we each consent to those courts.

Before anyone files anything, please contact us — most things are solved with an email.

13. Changes to these Terms

We may update these Terms. The "Last updated" date at the top always tells you when. If a change materially affects a Program you have already paid for, we will tell you directly rather than relying on you noticing this page.

SMS Terms & Conditions

Effective July 19, 2026.

1. Teddy Dupay Basketball Academy ("TDBA") sends customer-care and account text messages to parents and guardians of enrolled players: booking and event confirmations, schedule and logistics updates (such as check-in times, parking, and locations), payment receipts and billing notices for services they purchased, and replies to questions they text us.

2. You can cancel the SMS service at any time. Just text "STOP" to any message from us. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, reply START or sign up as you did the first time, and we will start sending SMS messages to you again.

3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at teddy@teddydupay.com.

4. Carriers are not liable for delayed or undelivered messages.

5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
